Hi, Mario!

Wow! 95 pages to say "I'm not sorry at all"? And, really, it was a rather lame excuse for not citing Berg in your opening brief, and for failing to assert then your belated challenges to standing caselaw.

Bring your checkbook!

Filing at 11:57 PM, even after you got a free 3-day extension...cutting it close!

Re: "Official Kenyan Government Records & numerous African Country News Accounts from 2004 to 2010 reporting Obama was Born in Kenya"

Answer; There are NO official Kenyan government records. But, there are several obviously forged Kenyan "birth certificates." There is not a single African newspaper account that said that it knew that Obama was born in Kenya based on any document or source. There is, in contrast, the OFFICIAL birth certificate of Hawaii, which the officials in Hawaii have confirmed the FACTS on twice.

Re: "" Birth registration in Hawaii falsified by Grandma Dunham who lived there to illegally get her new foreign born grandson U.S. Citizenship"

Hawaii did not then and does not now issue a birth document of any kind that says on it 'born in Hawaii"unless there was proof that the child was born in Hawaii. Obama's says that he was born in Hawaii, and this fact was confirmed twice by the officials of the Department of Health and the Department of Vital Records of Hawaii, and this in turn was confirmed by the governor of Hawaii, a Republican.

The claims that Obama's Certification were forged were checked out by the McCain Campaign and found to be false. Only two guys who would not give their real names made them anyway. Obama's Kenyan grandmother said repeatedly that Obama was born in Hawaii in the taped interview, and she said in another interview that the first that her family in Kenya had heard of the birth was in a letter from Hawaii.

Andrew Walden, a conservative columnist and blogger who lives in Hawaii, put it this way:

"For Obama to have been born in Kenya, Ann Dunham and Barack Obama Sr. would have had to fly from Honolulu to Mombasa, give birth in a substandard third world hospital, fly back and then somehow arrange for a fraudulent birth certificate to be entered by the State of Hawai`i on August 8, 1961 (at the time governed by Republican William Quinn). They would have also somehow planted the phony birth announcement in the Honolulu Advertiser (at the time edited by Republican Thurston Twigg-Smith) and the Honolulu Star-Bulletin. Hawai`i's current Republican Governor Linda Lingle would also have to be complicit in the cover-up as would all of the leftist 1960s University of Hawaii friends of Ann Dunham and Barack Obama Sr – among them US Rep. Neil Abercrombie.

In 1961, the roundtrip flight to Kenya would have been a very expensive, pointless, and time consuming epic journey for two starving students. Barack Obama Sr. had only been able to come study at UH Manoa with a free ticket on a donated charter flight with other Kenyan students. "

Re: "many African newspapers report as early as 2004 and 2006 that Obama was born in Kenya "

BUT they did not cite evidence. Moreover, the phrase "Kenyan-born" is ambiguous. In some countries, such as France, the meaning of French-born refers to the nationality of the parents. Obama's father was a Kenyan, you know. Finally, in some cases now the paper or the legislator could simply be wrong. By now the Kenya myth has gotten around, and some people believe it even without evidence. This is true in the USA, and it may be true in Kenya. Their belief is not a fact, especially since there are NO legal documents and the government of Kenya has not issued an official statement. There ARE legal documents from Hawaii, and the officials in Hawaii have issued official statements twice, and the governor has also confirmed. And there is this witness who recalls being told of Obama's birth in Hawaii and writing home about it (http://www.freerepublic.com/focus/news/2170432/posts).

Re: "and what the ambassador said that Obama’s place of birth in Kenya is a well-known attraction and what ranking members of the Kenyan Parliament recently said about Obama being born in Kenya? "

To some extent I have already addressed this. A Kenyan MP did say that Obama was born in Kenya. ONE MP. He did not cite any facts or any documents. He just said it. if he had said "Obama was born by immaculate conception," would you believe it?

Re the Ambassador. He has said that he did not understand the question. That is highly likely. I have some experience in interviewing people whose native language is not English, and sometimes they make mistakes. If he had been asked: Are you going to celebrate Obama's immaculate conception in Kenya?" He might well have answered Yes too. The single answer of a foreign diplomat whose native language is not English is meaningless. This is ESPECIALLY true when he says later that he misunderstood the question.

To take seriously the myth that Obama was born in Kenya requires a number of broad assumptions. First, that his mother had a passport in 1961. Obama has said that she did not, and that she applied for her first US passport when they were about to go to Indonesia. Obama also applied at the time, he says, and since he did travel to Indonesia and Indonesia says that he never had an Indonesian passport (call the Embassy to check), it is logical that he traveled on a US passport.

Obama indicated that his mother did not have a passport in his first book. The allegations and facts in this were undoubtedly checked by the Bush Administration when Obama announced his bid for presidency. They would know from their files (which, by the way, were not altered or deleted in the break-in) either that she did or did not have a passport in 1961. If she did have one, they would have indicated that fact as a way of showing that Obama lied and that he could have been born in Kenya. They said nothing. The most likely reason is that it is true that Obama's mother did not have a passport in 1961.

But, say that she did have a passport at that time, and say that she had gone to Kenya despite the expense and risk. Say that Obama was born in Kenya. Then, how did he get from Kenya to the USA without some kind of a US travel document? I mean, we do not allow foreign-born infants into our country (especially not black ones in 1961) without some kind of visa or US passport or the inclusion of him on his mother's passport.

If there were such a document, an application for a US visa or to change his mother's passport to include him. There would be a record of the application, and it would have been found. The Bush Administration made no such discovery.

So, we have:

1) An official Hawaii document that shows Obama was born in Hawaii.
2) Repeated confirmations by the officials in Hawaii that he was born in Hawaii
3) A witness who recalls being told about his birth in Hawaii.
4) His Kenyan grandmother saying at least once that he was born in Hawaii and no evidence that she said that he was born in Kenya or that he was born in a Kenyan hospital or that she was present in the place where he was born.
5) No official Kenyan documents showing that Obama was born in Kenya (except for obvious forgeries).
6) No US documents showing that Obama traveled from Kenya to the USA in 1961.

Adding to the previous. When I said "in Swahili" I may have been inaccurate. It may have been in the Luo language. Either way, the same facts apply. We know that the Kenyan grandmother (step-grandmother actually) was asked a question in English. We know that she does not speak English. We know the question in English, but we do not know the actual translation with all its connotations in the African language.

She answered YES, only yes, but what was the question? The interviewer sensed that there could be some ambiguity in the question, so he asked it another way, a simpler way: 'Where was he born?" And the answer came back repeatedly that he was born in Hawaii. Add this to the other interview in which she said that the first that her family had heard of Obama's birth was in a letter from Hawaii.

Re: "But you fail to address the fact that first she said on at least two occasions that she was present when Obama was born and then later in the inteview she said he was born in Hawaii. "

This is simple to answer. The tape recorded interview records a question "was she present when he was born?" which was asked in English. What was she asked IN SWAHILI? We do not know. We only know that the question in English was was she present WHEN he was born (not where he was born0 and that it was in English, and that the translator said that she said Yes.

But what did she actually say YES to? What was the real full question in Swahili that she was asked. Could it have been "was she present in Kenya when he was born in Hawaii (or in America)" or even simply "was she present in Kenya when he was born?" Again, we do not know.

That being the case we have NO evidence that she said that she was present when he was born in Kenya. And, of course, it is difficult to believe that his mother ever went to Kenya when it would have cost the equivalent of $20,000 for two round trip in those days (via either Tokyo or New York, no direct flights).

But in any case, there is NO evidence that she ever said that she was present where he was born in Kenya. In fact, the question was she present WHEN he was born is a key signal that the translation might be wrong, since in some languages you have to say "present WHERE" to get a result based on place. When just indicates time.

So there is no evidence that she ever said that Obama was born in Kenya or that she was present at his birth. What she did say, when she was asked "where was he born?" Was Hawaii, America repeatedly. That is on the taped recording. In another interview she said that the first that she had heard of Obama's birth was in a letter from Hawaii. In other words, the circumstantial evidence is strong that she never said that he was born in Kenya or that she was present when he was born. There is good evidence on the tape and in the transcript that she said that he was born in Hawaii when she was asked where he was born, and this is confirmed by the other interview in which she said that the first that her family had heard of Obama's birth was in a letter from Hawaii.

Re: "Do you deny that the Kenyan grandmother said early in her interview that she was present when Obama was born? "

Answer: She only said "Yes" to an unknown question. Therefore, yes, I deny that there is any statement from her saying that she was present either when or where he was born. But there is a statement from her saying that he was born in Hawaii.

So there is no evidence that she ever said that Obama was born in Kenya or that she was present at his birth. What she did say, when she was asked “where was he born?” Was Hawaii, America repeatedly. That is on the taped recording. In another interview she said that the first that she had heard of Obama’s birth was in a letter from Hawaii. In other words, the circumstantial evidence is strong that she never said that he was born in Kenya or that she was present when he was born. There is good evidence on the tape and in the transcript that she said that he was born in Hawaii when she was asked where he was born, and this is confirmed by the other interview in which she said that the first that her family had heard of Obama’s birth was in a letter from Hawaii.

Re: “Do you deny that the Kenyan grandmother said early in her interview that she was present when Obama was born? ”

Answer: She only said “Yes” to an unknown question. Therefore, yes, I deny that there is any statement from her saying that she was present either when or where he was born. But there is a statement from her saying that he was born in Hawaii.

I am sure you will agree with me that we can accept as fact that Obama's Kenyan grandmother was never in the United States in 1961 or any year near that year.

Regarding what the Kenyan grandmother said about Obama being born in Kenya, you say that the tape of her interview shows that she said he was born in Hawaii. But you fail to address the fact that first she said on at least two occasions that she was present when Obama was born and then later in the inteview she said he was born in Hawaii.

Do you deny that the Kenyan grandmother said early in her interview that she was present when Obama was born? If you do not deny it, then can you tell me why she would have said something like that?

Also, can you explain why grandmom's statement that she was present when Obama was born is consistent with what many African newspapers report as early as 2004 and 2006 that Obama was born in Kenya and what the ambassador said that Obama's place of birth in Kenya is a well-known attraction and what ranking members of the Kenyan Parliament recently said about Obama being born in Kenya?

Do you not believe that all this circumstantial evidence pointing to a Kenyan birth--along with much more which I have included in my Catalog of Evidence; along with Obama only posting a scanned image of a COLB (not his contemporaneous long-form birth certificate) on the internet which authenticity has been questioned by some knowledgeable persons on the internet (of course which needs to be confirmed by identified forensic experts); along with Hawaii refusing to confirm that the internet-posted COLB, the only "evidence" that Obama release of his Hawaiian birth, is authentic; along with no hosptial as of yet confirming that Obama was born there or that Stanley Ann Dunham was even a patient there despite being asked repeatedly to do so; along with no statement from Congress or any federal official that they personally confirmed based on conclusive evidence that Obama was born in Hawaii; along with no court in the land confirming that Obama was born in Hawaii despite the over 60 lawsuits filed on the issue; along with not one person with personal knowledge coming forward who has confirmed the facts of an alleged 1961 Obama Hawaiian hospital birth; along with Obama's unexplained refusal to release his 1961 contemporaneous birth certificate and his other birth, travel, work, and education papers; along with Obama refusing to confirm that he wrote or at least signed the January 24, 2009 congratulatory letter to Kapi'olani Medical Center in which it is stated that Obama was born in that hospital; and along with the relative ease with which a "birth certificate" could be fraudulently created in 1961 and even today-- is all cause for serious concern for any reasonable thinking American? If all this circumstantial evidence is cause for such concern, why does Obama not simply dispel this legitimate concern by producing his 1961 contemporaneous birth certificate which is the only evidence that exists that will put an end to the quesiton of where Obama was born?

Re: "Discovery, scrutinized by both sides in court, is the only answer. "

First, there has never been discovery granted for any other president's records. Second, Obama has shown that he was born in Hawaii with the official birth certificate of the state, the facts on which were confirmed by the Republican administration twice. Third, if a court were to grant discovery, then I can assure you that every future president would have a group that claims that he was born in Upper Volta or Outer Mongolia or Rowanda or Tasmania and would demand that a court discover the truth even though their claims had all been made up--as have the claims of birth in Kenya for Obama in this situation.

Made up. Like the grandmother tape edited to remove her actual words saying that Obama was born in Hawaii. Like the claim that Pakistan was on a "no travel list.' Like the assertion that the Certification of Live Birth is not the official birth certificate of Hawaii, when it is the official and ONLY birth certificate issued since 2001. Like the claim that the officials did not confirm, when they did twice.
