South Africa’s mix of English and Dutch law needs to be ‘Africanised’ to make it more relevant, says Cape Judge President John Hlophe.
“I believe that people need law that embodies their own culture and their values. We need to Africanise our law and make it relevant to the masses. There is a huge void in our legal system,” Hlophe said in Durban last week.
Noting South Africa’s common law was a fusion of English and Dutch law, Hlopehe said it had been imposed at the expense of indigenous law. “If we do not transform the legal system we will have a problem because people will not identify with the system,” he said. “We need to have the situation where people obey the law not because they fear being sent to jail, but because they feel that it is the right thing to do and something they are proud of.”
Hlophe said South Africans had a legitimate expectation for transformation in the judiciary. “I describe transformation as change for the better. Society is crying out loud for transformation. The citizens have a legitimate expectation.”
Hlophe also said there was a need for courts to use African languages.

This organism John Hlophe sounds like Sonya Sotomayor in espousing that a Nations laws be predicated on ones own culture and values.
English law is predicated on the Ten Commandments and I could only image what this nasty piece of work has in mind. His statement regarding obedience to the law, that it should not be in fear of punishment, but because it the right thing to do, Duh!
It should appeal to the masses? What do they do stupid, decide what laws they want and don’t want. Your nation under uncivilized Black rule is in a state of anarchy.

Can anyone say MUTI? Does this mean that he would leagalise the practice of Sangoma's ( witch doctors ) to prescribe Muti medicine to their so called patients? Let me explain what Muti is, it is the mutilation of body parts from the living victem for the sake of healing someone. For example, the Sangoma recomends to his diseased patint to go out, find a young boy as young as a new born up to 10 years old and cut off his genitals to bring to the witch doctor to cook up a potion with or grind into a powder etc to be used as a cure. These people are sick. Would this also leagalise the sangoma's precsription for AIDS carriers to go and rape a virgin ( toddlers )to cure them from AIDS? To kill and gang rape lesbians to correct their way of life? ( not that I agree with homosexuality )
With the numerous tribes in South Africa, how would a Zulu law affect the view of law of the Xhosa who hate each other.
Would this also incorporate Chakas law that if you don't join and serve his army you are killed? There are so mny questions regarding this insane idea, I can't see it really happening. Oh wait these are South African Bantus after all.

How about this, we trade our loud irresponsible ghetto blacks for all the white people still living in South Africa and chimbwe, then they can africanize it all they want.
