It seems that Phil Berg may finally get his day in court.
The Democrat activist lawyer, who was the first to bring forth a legal challenge to US-president elect Barack Obama’s eligibility to hold office based on his “natural born” status, is scheduled to have the US Supreme Court discuss the merits of the suit on January 9, 2009.
Berg originally brought his suit to the Supreme Court in October. Berg filed a Writ of Certiorari and an application for injunction of the election; the injunction was rejected by Judge David Souter’s Clerk. The case has been in legal limbo ever since.
Berg’s case marks the third time the US Supreme Court will argue the merts of a “natural born” lawsuit. The two previous cases, filed by New Jersey resident Leo Donofrio and Cort Wrotnowski. were both rejected.
“I know that Mr. Obama is not a constitutionally qualified natural born citizen and is ineligible to assume the office of president of the United States,” Berg wrote in a statement on his Obamacrimes.com website.
The “natural born” status of president-elect Obama remains in question. Berg contends Obama was adopted by his step-father while living in Indonesia, thus removing his “natural born” status. An audio recording of Obama’s Kenyan grandmother admitting Obama was born in Kenya has surfaced. Additionally, Obama’s own “Fight The Smears” website said Obama was a Kenyan citizen until 1982.
Hawaii governor Linda Lingle, a Republican, has sealed Obama’s birth certificate from public access. A member of Obama’s election campaign dismissed the lawsuits as “pure garbage“.

I'm not in any group, I'm a logical thinker trying to connect the dots. History is written and can not be changed. The Berg's of the world started the case and it has now evolved beyond the original complaint that BHO is not "natural born". It has evolved to the historical fact that he is not a U.S. Citizen. In order for BHO to prove he is a citizen, he needs to produce his records. The INS Department can force those records or lack thereof to be produced. Again, this has evolved beyond the original question. The evolution was based on BHO's writings and history at the time.
If you own a business today you are required to prove your employee is a citizen, if you fail to do that, the government will fine you. Instead of the employee bringing proof to the employer from INS, the employer is put in a position of, instead of making widgets becoming an INS investigator or find himself in jail and out of business! Our system is broken and people like BHO knows it and is taking full advantage of it! This is my last post.
John — forgive me, I had to go to sleep, and I missed a lot of it. Let me jump on a couple of things:
o "there is no doubt in your mind that BHO’s citizenship is beyond question?" I wouldn't say there's *no* doubt, because we are only human and can be wrong. But in order to prevent chaos in this country, we have legal systems for determining the truth in a civil, orderly manner. The way I see this, Obama's COLB is proof that he was born in Hawaii, but it is "rebuttable" proof, which means someone else has the right to come along and offer contrary evidence. None of the offers I've seen have been even remotely convincing, so in my mind there is no *reasonable* doubt.
o "I do know that BHO has locked all of his record, that is even reported in the Main STREAM Media." No, that's a good example of something you think you know that you don't know. We know that a lot of Obama's records are unavailable to the public, and that is true of all citizens. (The State of Hawaii made a statement recently that his records have been treated no differently from anyone else's.) If you want to be sure of getting to the truth, please check your sources carefully. I don't think there's any real confirmation that he's taken any action to lock his records — or, for that matter, that he's spent money on lawyers fighting these cases. I won't believe it till I see credible confirmation, not just endless repetition of internet rumors.
o "I can’t prove anything unless the records are released." This is the key. Your argument runs, "I know something is fishy, and you have to show me all the documents I can think of so I can get to the bottom of what it is." John, do you understand why our system is 100% opposed to that way of doing things? I mean, I'm not saying that you're a deluded wingnut bringing nuisance suits, but there might be some of them out there. How would your scheme protect us against them?
o "I will issue a complaint to INS that BHO is an illegal alien." OK. Well, that's not exactly what I suggested, because I don't think that's your best shot — and even if he's a real citizen, he could fail to be a "Natural Born Citizen," and you would still get your wish.
So let me give you a more specific suggestion:
Obama's evidence is the Certification of Live Birth, which is an official-looking document which says he was born in Hawaii. If it's a valid document, he is (*almost certainly!*)
a Natural Born Citizen, If it's not valid, Obama is perpetrating fraud for using it.
(I say "almost" because the Donofrio/Wrotnowski line of cases assumes that he was born in Hawaii and is still not a NBC. But I don't recommend that approach — the Supreme Court has never found a native-born person not to be a NBC, and most legal observers take a dim view of these cases.)
Study Berg's evidence that the document is fraudulent — study it hard because you want to get this right. See if you find any of it really convincing. If you do, then figure out where the fraud was committed. If it involves falsifying Hawaii documents, then maybe the Hawaii Attorney General's office is one place to start. If he used false documents to become senator from Illinois, maybe you should try to have charges filed there too. Plus the possibility of federal charges — Patrick Fitzgerald is a tough prosecutor, I'm sure he'd love to know about the evidence if it's something convincing that he could make a case on.
John, let me be clear. I think you're wrong. I think the chances of your succeeding are as close to zero as they could possibly be. And I'm not a lawyer.
But I am honestly giving you my best advice. If there is any chance of proving what you're trying to prove, I think I'm pointing you in the right direction.

1) The cases have not been denied. SCOTUS only denied stopping the election process. They have not ruled on cert or whether or not to hear the issue. They are holding that and remaining MUM which is unusual in my opinion. If they intended clearly to not hear the issue, they would have DENIED WRIT, which they have clearly not yet done. Perhaps they will, but my crystal ball is broke and I can't tell. Maybe you could refer me to the occult store who sold you yours.

I would say one of the strongest pieces of evidence I "have" is Obama's own admission on his own website "fight the smears" wbere he admits that he was a british/kenyan citizen at birth. That is if you give weight to the precedent set in Wong Kim Ark and Minor. However, there are other items that could prove stronger if the courts allow the cases to proceed without blocking them. One thing that has never been defined is the manner of redress that citizens have when their rights have been violated. First Amendment gives the right of redress, but the manner has never been spelled out or defined. This is an issue which seems to be causing "standing" to bounce these court cases out of court.

The birth certificate issue is a GIANT RED HERRING (probably encouraged by Obama himself) TO DIVERT FROM THE REAL ISSUE — that is, BHO is NOT an Article II “natural born citizen” because his dad was a Kenyan/British citizen when Barack was born. Case closed.
If 1/20/09 comes and goes with a usurper in the Whitehouse (that is, Obama is definitely NOT an Article II “natural born citizen” — dad Kenyan/British citizen at BHO’s birth –albeit he MAY BE a 14th Amendment “citizen”) with usurper enablers in Congress and the Supreme Court … God help us because many of the people will — rightfully and under our Constitution and Declaration of Independence — endeavor through other means to take back the Government from what is nothing less than a non-constitutional coup d’etat.
SCOTUS now does have the power to forestall that grim yet inevitable scenario, otherwise the blood and possible loss of our Constitutional Republic is SQUARELY ON THEIR HEADS.

MaineSkeptic, I don’t care if it’s anything that would help in a legal process. Many truths are of no help in a legal process because of the structure not allowing them. Does not dismiss the fact that it’s the TRUTH. And it is NOT rumors and unsubstantiated gossip. If this site would post my previous posts and not censor them, my more recent post would be more clear.
Emily, I understand what you’re saying, but spelling truth with all capital letters doesn’t prove anything, it just makes it look like you’re yelling.
You know, some people are claiming that Obama is not legally qualified to be president, and that would have to be demonstrated in a court of law. So maybe *you* “don’t care if it’s anything that would help in a legal process,” but those of us who are seriously considering these questions care very much.
Real evidence is appreciated. Hot air is not.
Well, let’s try this again. richCares, you are awfully cocky for a novice. Real professionals are never that cocky. SCOTUS has not denied hearing the cases. They have not ruled on CERT. They have ONLY DENIED stopping, delaying or disrupting the electoral process. They have not ruled on Cert or the Order would have been published along with the pages of other Orders Denying Cert in other cases.
Perhaps SCOTUS will deny cert, but my crystal ball is BROKE and I can’t tell. Maybe you could refer me to the occult shop that sold you yours. That is, if yours really works.
richCares, also, perhaps you would ask your crystal ball why Obama has refused to release any of the normal documents that are released by any other presidential candidate, such as 1) a REAL birth certificate; 2) college applications; 3) thesis; 4) medical records; 4) selective service documents; 5) all college records, and many other documents which have been asked for which he has refused to release.
And maybe your crystal ball can tell us why the Kenya government has sealed all of the records pertaining to Obama.
I once heard a saying, “If it looks like a duck, and quacks like a duck, it is a duck.” Well, this pertains to Obama. I only wish he were no more dangerous than a duck. On that note, maybe your crystal ball can also tell us that while Obama has been in the US for years, why does he not have one regular guy-friend from his past (who is not a radical, communist, socialist, or terrorist or convicted criminal) who will step forward and vouch for his long-standing integrity? I think it’s interesting that he has none.

Thanks for your advice. However your first advice seems more logical. We have put the cart before the horse. It can not be proved that BHO is not a citizen without evidence. The evidence is lock so the proof can not be offered. However, if I can trigger INS to do their duty, they can subpoena the records. They can then state the facts. Again, I am going on history and what is in BHO’s book. I am not asking if he is NBC, I am asking if he is a U.S. Citizen. If it is found that he is not a U.S. Citizen then he is not qualified. His records must be examined by the INS to find proof that at some point in his life he renounced his Indonesian Citizenship and renewed his U.S. Citizenship. The historical facts seem to point to the fact he or his mother did not do what was necessary to regain his U.S. Citizenship when he returned to Hawaii. His if he traveled to Pakistan on a U.S. Passport as an adult at age 20 and he had paperwork with INS when he returned to live with grandma, he is golden. If either or both can not be proved by BHO then INS must announce their findings. If they find that technically he is not a U.S. Citizen then any Court must hear the case that he is not qualified.
If the INS will do their job, it put the burden of proof on BHO where it belongs. It is not up to Berg to prove he is not a U.S. Citizen. Berg is not seeking the office, BHO is seeking the office and must prove he is qualified. He has not offered that proof in this respect to the best of my knowledge or anyone’s knowledge.
In my complain, I am not suggesting that he or anyone committed fraud by altering documents. I have no qualifications to prove such an assertion.
But as a historian and a logical thinker, if he can not show INS documents to counter what I’m asserting then he is in deep trouble.
I am now left to find out was it takes to trigger INS. I know my obligations as an employer to prove my workers are legal. I need to figure out how to report an Illegal alien to the INS and then be able to follow up to ensure they have done their job. If this happen, I am 99% sure that they will find technically he is not a U.S. Citizen. And, I have shifted the burden of proof on the right party. BHO should have no problem producing his documents to INS.
