Within minutes of rejecting New Jersey resident Leo Donofrio’s “natural born” lawsuit Monday, the US Supreme Court scheduled to hear another lawsuit raising the same challenges to President-elect Barack Obama’s eligibility to hold office.
Cort Wrotnowski v. Susan Bysiewicz, Connecticut secretary of state, also makes the dual citizenship argument brought forward by Donofrio. It was rejected by Justice Ruth Ginsburg Nov. 26, but was resubmitted to Justice Antonin Scalia and was not heard from until moments after the Court rejected the Donofrio case.
Donofrio wrote on his Natural Born Citizen blog the Wrotnowski case “includes a more solid brief and a less treacherous lower court procedural history [....] “I must stress that [Wrotnowski] does not have the same procedural hang up that mine does.”
The original “natural born” lawsuit, filed by Democrat activist lawyer Phil Berg still sits in the Supreme Court, waiting a response from the Obama camp. The lawsuit filed by Berg claims the birth certificate posted on the Obama campaign website is a forgery, and also claims Obama may in fact be an Indonesian citizen. Obama’s birth certificate has been sealed by Hawaii Governor Linda Lingle.
Seventeen other “natural born” lawsuits are making their way through American courts, including one filed by former Obama Senate rival Alan Keyes.
