While Democrat activist lawyer Phil Berg, who filed the original “natural born” lawsuit, currently has his case in legal limbo before the US Supreme Court, the Court will hold closed-door hearings on a similar suit filed by New Jersey resident Leo Donofrio.
The hearing will take place on December 5, 2008, ten days prior meeting of the Electoral College.
Donofrio originally brought his suit, “Leo C. Donofrio v. Nina Mitchell Wells, Secretary of State of the State of New Jersey” (US Supreme Court Docket No. 08A407), before the election. It sought a stay of the “national election” pending Supreme Court review of whether not only Barack Obama, but also his Republican rival John McCain and Socialist Worker’s Party candidate Roger Calero are “natural born” citizens, as is required by Article 2, Section 1, Clause 5 of the Constitution of the United States.
If four of the nine Justices vote to hear the case in full, oral arguments may be scheduled for the suit.
Currently, seven other “natural born” lawsuits are making their way through American courts, including one filed by Republican Alan Keyes. An Obama spokeswoman has collectively dismissed the suits as “pure garbage“.
Obama’s own campaign website has stated the president-elect was a Kenyan citizen until 1982. Audio of Obama’s Kenyan grandmother saying he was born in Kenya has recently surfaced.
